Based on your current HR Department paperwork, we will work with you to develop or evolve your HR Manual for the operation of a franchise business model, including policies for reducing your liability when working with franchisees.

HR Manual

IQ Franchising works with you to develop a HR Department Manual that balances the goal of providing operation guidance with the requirement to avoid “joint-employer” and other franchise related scenarios. 

Some of the key responsibilities of the franchisor HR department include:

  • Recruitment: Recruiting candidates for various positions within the franchisor company

  • Training and Development: Training and development programs for employees, including onboarding and ongoing training to ensure that employees have the necessary skills to perform their jobs effectively;

  • Performance Management: Processes and tools to monitor employee performance, provide feedback and coaching, and identify opportunities for improvement;

  • Compliance: Ensuring compliance with employment laws and regulations, including wage and hour laws, anti-discrimination laws, and safety regulations; and,

  • Employee Relations: Providing support and guidance to employees on a range of issues, including workplace conflicts, grievances, and disciplinary actions.

HR Department, and the Franchisees

Providing assistance to your franchisees is a necessary activity on the part of the franchisor. And it is understood that, as a franchisor, you seek to help your franchisees with their business operation in efforts to foster their success. However, in light of the regulatory decisions, it is imperative that precautions are taken in the manner in which you provide assistance to franchisees. The HR Manual is designed to address this, and other, matters.


With a regulatory basis in mind, the HR Department Manual will balance the goal of providing operation guidance with the objective of avoiding a “joint-employer” scenario. It is important to keep in mind that:

The Franchisee is responsible for ALL employment decisions!

Further to this point, we will discuss such items as limiting engagement in:

  • being involved with the franchisee’s recruiting, interviewing or hiring process

  • providing franchisee employee training

  • providing operational performance standards

  • providing HR manuals; and,

  • other services that directly relate to franchisee employees (e.g. Employment Policies, Forms & Procedures)

Within the HR Manual, should you decide to present "example templates" vs. instructing franchisees to work with local firms specializing in HR matters, we will work with you to limit exposure, by providing the documents solely as an optional tool.

Additionally, these "templates" would be developed to avoid expressing “best practices” as the term “best practice” could be perceived as workplace rules and thus governing the franchisee's employees directly.
